Terms and Conditions

1. Introduction

These Terms govern services by PINC Consulting, a software studio specializing in B2B software, data science, AI, and iOS/Android app development. Users agree to be bound by accessing services.

2. Services Provided

  • B2B Software Development: Custom solutions tailored to business needs.
  • Data Science and AI Services: Data analysis, machine learning, and AI solutions.
  • Mobile Application Development: iOS and Android creation and modification.

3. Intellectual Property

All intellectual property rights related to the services and products provided by PINC Consulting remain the property of PINC Consulting unless otherwise agreed in writing. Upon full payment, clients may receive a license per separate agreement.

4. Payment Terms

Payment follows individual agreements. Per EU Directive 2011/7/EU, late payments incur interest at rates published in the Belgian Official Gazette plus EUR 40 fixed compensation for recovery costs, with additional recovery costs claimable.

5. Confidentiality

Both parties maintain confidentiality regarding proprietary information, including business plans, data, and technical specifications shared during projects.

6. Data Protection and GDPR Compliance

The company complies with GDPR and EU data protection laws, processing personal data only as necessary and implementing security measures per our Privacy Policy.

7. Limitation of Liability

PINC Consulting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses.

8. Warranty

Services are provided with reasonable skill and care, though uninterrupted or error-free service is not guaranteed.

9. Indexation Clause

Ongoing service prices may adjust annually using consumer price index or relevant indexes per service agreements.

10. Termination

Either party may terminate with written notice for breach. Clients pay for rendered services through termination.

11. Governing Law and Jurisdiction

Belgian law governs these terms; disputes fall under exclusive Belgian court jurisdiction.

12. Changes to Terms

The company may modify terms at any time, notifying clients of significant changes. Continued use constitutes acceptance.
